The concept of taking legal action over the wrongful death of a family member is an extremely uncomfortable topic for many Illinois residents. As such, the bereaved often languish in impenetrable grief, unable to find a way to cope. We are not saying that seeking justice will make your pain go away. What we are saying is that it can help in some cases.

When a person dies in a wrongful manner, it feels different than if the person died from old age or illness. It is often abrupt, sometimes violent and always shocking. For example, if a person is hit by an intoxicated driver and suffers violent and fatal injuries, the victim’s family is completely unprepared for the loss. Further, knowing the death was 100 percent preventable increases the family’s despair.

Pursuing a wrongful death claim is a way for family members to be proactive. While it cannot replace the person you love, it can bring the responsible party to justice. For many, simply doing something is cathartic and punishing the wrongful party at the same time is even more so.

The point we want to make is that it is unwise to dismiss a wrongful death action out-of-hand. It is much better to remain open to all potential solutions that may bring you and your remaining family members a measure of peace. Helping to ensure the party who caused the wrongful death of your loved one cannot harm another person is also mentally and emotionally beneficial.
